Abstrakt
| The article deals with the meaningfulness of the criminal liability of legal persons, which was codified by Act No. 418/2011 Coll. First, the basics of the criminal liability of legal persons and its problematic aspects, especially when sanctioning non-functional legal persons, are presented, and the facts of the criminal offence of credit fraud under Section 211 of the Criminal Code are characterized. The effectiveness of criminal sanctions is then examined using this offence as an example. By analysing individual cases where a legal person has committed the offence of credit fraud, we then conclude that a significant majority of penalties are ineffective because the legal persons punished are either non-functional at the time of the offence or during the criminal proceedings. In the normative analysis of the legal text, methods based primarily on the principle of value consistency and a formal systematic approach were used, which was supplemented by a kind of simplified form of case analysis.. |
